You may be required to create an account to use our Site. You must be over eighteen (18) years old to use our Site. Otherwise, you may only visit the Site under the supervision of a parent or guardian.

You are (or, if you are under 18, your parent or guardian is) responsible for your account. You are solely responsible for any activity on your account. If you are sharing an account with other people, then the person whose billing information is on the account will ultimately be responsible for all activity. If you register as a business entity, you personally guarantee that you have the authority to agree to the Terms on behalf of the business.

You are solely responsible for any activity on your account. Therefore, it is important to keep your account password and any device from which you access the Services secure. If accessing the Website and/or Services via a mobile device, we recommend that you do not jailbreak or root the device.

These Terms do not create any agency, partnership, joint venture, employment or franchisee relationship between you and us.

You may submit the design of your custom scented candle to make an order on our Site. After designing your custom scented candle and passing through our ordering process, and by clicking the button finalizing the order process, you submit a legally binding order with regard to the candle(s) contained in the virtual basket.

We will accept your offer within 1 business day by transferring an order confirmation in written form via e-mail after receiving payment for your order.

Should the seller not accept the Client’s offer within the aforementioned period of time, this shall be deemed as rejecting the offer with the effect that the Client is no longer bound by the Client’s statement of intent.

The order processing will usually take place either via e-mail or via automated order processing. It is your responsibility to ensure that the e-mail address you provide for the order processing is accurate so that e-mails sent by us can be received at this address.

USE AND ACCESS TO THE SITE

We allow access to the Site on a temporary basis and we reserve the right to withdraw, restrict or change our Services at any time and without notice. We will have no liability if for any reason our Site and services are unavailable at any time or if the content is changed or is out of date.

We grant you a limited, non-exclusive, non-transferable and revocable licence to visit the Site, subject to the following restrictions:

• You will not violate any laws in connection with you visiting the Site, including any local, national and international laws that may apply to you. Unauthorised use of this Site may result in us claiming for damages or you be criminally liable.

You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By failing to comply with this provision, you would commit a criminal offence and your right to access the Site will cease immediately and we will report your actions to the relevant authorities.
• You agree not to interfere with or try to disrupt the Site, for example by distributing a virus or other harmful computer code.
• The name Maison Frédériche and other marks, phrases, logos and designs that we use in connection with our Services, are trademarks, service marks or trade dress of Signature Home Fragrance SA in Switzerland and other countries. You require our express written permission to use our trademarks, service marks or trade dress.
• By using our Site, you agree that we may provide you information electronically (by email, etc.) instead of mailing you paper copies.

Certain functions of the Site will require an active internet connection. The connection can be Wi-Fi, or provided by a mobile network provider, but we cannot take responsibility for the Site not working at full functionality if you do not have access to an active internet connection. In using the Site, you accept responsibility for any charges incurred for the cost of data for the duration of the connection while accessing the Site, or other third party charges, including roaming data charges. If you are not the bill payer for the device on which you are accessing the Site, please be aware that we assume that you have received permission from the bill payer for using the Site.

Any design or custom scented candle you create on our Site generates Intellectual Property. You agree to grant us an exclusive, non-transferable right to all such Intellectual Property arising from the design and customisation of the Product, in order to use it for demonstration and further sale of further products with the same Intellectual Property. You should not in any way register any Intellectual Property arising from the custom scented candle you create on our Site.

You must not use any part of the Site for commercial purposes without a licence from us or our licensors. You may not reproduce in any format (including on another Site or mobile app) any aspect of the Site or our Services (including content, images, designs, look and feel) without our prior written consent.

If, in our opinion, you are in breach of these provisions, your right to use the Site and the Services will cease immediately and you must either return or destroy (as required by us) any copies of the materials you have made.

The Site is provided without any guarantees, conditions or warranties as to their accuracy or functionality. To the extent permitted by law, we hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any Sites linked to it and any materials posted on it (whether by us or a third party), including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

We will attempt to make the product and quantities advertised on our Site available at all times. However, this cannot always be guaranteed and we will not be liable for any products that are not available at the time of your checkout. We will notify you as soon as possible when this occurs and advise you on what to do to solve this problem.

We reserve the right to refuse or terminate/cancel orders when there has been Site malfunction or error such as technical difficulty or an incorrect price being displayed. Notification to the customer will be facilitated immediately after this has been notified to us and any payment already received from the customer will be refunded.

All our promotions are subject to availability and while stocks last.

The product descriptions in the Seller’s online shop do not constitute binding offers on the part of the Seller, but merely serve the purpose of submitting a binding offer by the Client.

Unless otherwise stated in the product descriptions, all prices indicated are end prices and include all value-added taxes. It is your responsibility to pay all and any local taxes, tariffs and duties accruing from the purchase of your custom scented candles. We will not be responsible for any orders which are seized by customs. You should be aware of the laws regarding the importation of goods in your country or the country into which you are sending your order.

All prices indicated are subject to change without notice. All orders will not be dispatched unless paid for in their full amount. We will accept no responsibility for any orders not being dispatched because of failure to provide full payment of the amount.

All payments can be made using one of the methods mentioned in our Site. We use Stripe Payment Platform (‘Stripe’) as our main payment service provider, which handles all our payments on the Terms and Conditions of Stripe which can be found in Stripe’s address: https://www.stripe.com/. Though we will do our best endeavours to contact Stripe to fix any pricing mistakes that may result when making your Order, we will accept no responsibility for any pricing mistakes whatsoever.

We provide the following Delivery Options:

• Delivery in the UK, 3-5 days via ShippingBo, at 8 GBP per delivery
• Delivery in the EU and Switzerland, 2-5 days via ShippingBo, at 7-13 GBP per delivery
• Worldwide shipping, 6-12 days via ShippingBo at 16 GBP per delivery
• Free worldwide shipping on gift certificates

We always use the exact address details you enter, so make sure to check you’ve given us the correct information before you place your order. If you’re unsure, try the Post Office address finder, as we can’t accept liability for late or failed deliveries due to an incorrect address.

We can’t guarantee delivery on specific dates. It’s possible that Customs in many countries may add additional duties or charges, which we have no control over. The charges would be applied in the receiving country, so we cannot predict or influence what they may be. You are responsible for paying these charges should they arise. We do our best to keep up with what’s happening in countries we deliver to, and we reserve the right to decline an order if we think it will be delivered unsafely, or if we think charges may be imposed.

If your delivery is late, lost, incorrect or contains a damaged item, we will do everything we can to get the issue resolved promptly.

Should the assigned transport company return the Order to us because delivery to you was not possible will make you responsible for bearing the costs for the unsuccessful dispatch.

The risk of accidental destruction and accidental deterioration of the sold goods shall in principle be transferred to you when they come into the physical possession of you or a person identified by yourself to take possession of the custom scented candles.

We do our utmost to ensure that every custom scented candle is nothing but delightful. From the premium quality perfume oils to the all-natural wax and from our perfumer’s expertise to the designer holders. That is why we guarantee your satisfaction. Should your custom scented candle not be what you were hoping for, you can get your money back or design another candle. To do that:

• Fill out the return form and insert it into the original package with the candle
• Label the package with the return address and send it back to us:

• Your refund or gift certificate will be sent within one week upon us receiving the return shipment.

All and any returns are subject to the following conditions:

• Please ensure that your return package is received within 15 days of delivery, going by the date stamp. The processing of your return will take 1 week after receiving your return package.
• If you’ve opted to get your money back, you will be refunded through your original payment method. You will receive the full amount you paid for your candle, including the original shipping costs, excluding the return shipping costs.

We do not accept returns of more than one candle per order. Also, we do not accept successive returns without any retained orders in between.

Any orders that have been paid for with a gift certificate will only be refunded with a new gift certificate.

These Terms, together with our Privacy Policy, supersede any other agreement between you and Maison Frédériche regarding the Site. If any part of the Terms is found to be unenforceable, that part will be limited to the minimum extent necessary so that the Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Terms is not a waiver of our right to later enforce that or any other part of the Terms.

We may amend the Terms at any time by amending this page or, if we believe the changes are material, we will let you know by notifying you via the Site or sending you an email about the changes. You are responsible for reviewing and becoming familiar with any changes. Your use of the Site and the Services following the changes constitutes your acceptance of the updated Terms.

Your use of this Site and any dispute arising out of such use of the Site is subject to the laws of Switzerland.
